The e-commerce website of Meldrone, a self-employed business with its registered office at Rue du Tombeu 3B, 4280 Moxhe, Belgium, VAT BE 0783.757.426 (hereinafter referred to as “Meldrone”), offers its customers the opportunity to purchase products from its online store.
These General terms and conditions (“Terms and conditions”) apply to every order placed by a visitor to this e-commerce website (“Customer”).
By placing an order through the Meldrone online store, the Customer expressly accepts these Terms and conditions and agrees to their applicability, to the exclusion of all other terms and conditions.
Any additional or conflicting terms and conditions of the Customer are excluded unless they have been expressly accepted by Meldrone in writing and in advance.
Article 2: Prices
All prices stated are expressed in euros (EUR) and are exclusive of VAT and any other taxes or charges that must be borne by the Customer.
Where delivery, reservation or administrative charges apply, these will be stated separately.
The stated price applies exclusively to the products as described. Accompanying photographs are for illustrative purposes only and may contain elements that are not included in the stated price.
Article 3: Offers
Although the online catalogue and e-commerce website are compiled with the greatest possible care, the information provided may occasionally be incomplete, contain material errors or no longer be up to date.
Obvious errors or mistakes in an offer are not binding on Meldrone. With regard to the accuracy and completeness of the information provided, Meldrone is subject only to a best-efforts obligation.
Meldrone cannot be held liable for obvious material errors, typographical errors or printing errors.
If the Customer has specific questions concerning, for example, dimensions, colour, availability, delivery times or delivery methods, the Customer is requested to contact our customer service team in advance.
All offers are subject to availability and may be amended or withdrawn by Meldrone at any time.
Meldrone cannot be held liable if a product is unavailable.
If an offer is valid for a limited period or subject to specific conditions, this will be expressly stated in the offer.
Article 4: Online purchases
Purchases are made through the Meldrone online store.
The purchasing process is as follows:
-
the Customer selects one or more products;
-
through the shopping cart, the Customer is asked to provide the following information:
-
surname;
-
first name;
-
address;
-
telephone number;
-
email address.
-
The Customer may also create an account for future or repeat orders.
The Customer can choose from the following payment methods:
-
credit card;
-
debit card;
-
bank transfer.
After selecting the payment method and confirming the order, the Customer will receive an email confirming the order.
Meldrone reserves the right to refuse an order in the event of a serious breach by the Customer relating to previous or current orders involving that Customer.
Article 5: Delivery and Performance of the Agreement
Products ordered through this online store are delivered in Europe.
Delivery is carried out by Bpost. Meldrone may change the carrier at any time. If the delivery method changes, the Customer will be informed via the email address provided when placing the order.
Unless otherwise agreed or expressly stated, the goods will be delivered to the Customer’s address within 30 days of receipt of the order.
Any visible damage, quality defect or other deficiency relating to the delivery must be reported to Meldrone by the Customer without delay.
The risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the goods.
However, where the carrier has been instructed by the Customer to transport the goods and that carrier was not offered as an option by Meldrone, the risk passes to the Customer upon delivery of the goods to that carrier.
Article 6: Retention of Title
All delivered products remain the exclusive property of Meldrone until full payment has been received from the Customer.
Where necessary, the Customer undertakes to inform third parties of Meldrone’s retention of title, including any party seeking to seize goods that have not yet been paid for in full.
Article 7: Right of Withdrawal
The provisions of this article apply exclusively to Customers who purchase products online from Meldrone in their capacity as consumers.
The Customer has the right to withdraw from the agreement within 14 calendar days without providing any reason.
The withdrawal period expires 14 calendar days after the day on which the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the final shipment or final item.
To exercise the right of withdrawal, the Customer must inform Meldrone of the decision to withdraw from the agreement by means of an unequivocal statement, for example in writing by post or email.
Meldrone can be contacted at:
Meldrone
Rue du Tombeu 3B
4280 Moxhe
Belgium
The Customer may use the standard withdrawal form provided below, although use of this form is not mandatory.
To comply with the withdrawal period, it is sufficient for the Customer to send the notification concerning the exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Meldrone without undue delay and, in any event, no later than 14 calendar days after the day on which the Customer informed Meldrone of the decision to withdraw from the agreement.
The deadline is met if the Customer returns the goods before the 14-day period has expired.
The direct costs of returning the goods are borne by the Customer.
These return costs are estimated at a maximum of approximately EUR 125.
The Customer is requested to return the products in their original condition and packaging, together with all supplied accessories and operating instructions.
If a returned product has diminished in value, Meldrone reserves the right to hold the Customer liable for any reduction in value resulting from handling of the goods beyond what is necessary to establish their nature, characteristics and functioning.
All returned items will be carefully inspected.
As a general principle, the consumer may inspect the product only to the extent that they would reasonably be permitted to inspect it in a physical store.
Returned products may be opened but must not have been used beyond what is necessary to determine their nature, characteristics and functioning.
Where a product has diminished in value as a result of excessive handling by the Customer, the corresponding loss in value may be charged to the Customer.
If the Customer requested that the performance of services begin during the withdrawal period, the Customer must pay an amount proportionate to the services already provided up to the point at which the Customer informed Meldrone of the decision to withdraw, compared with the full performance of the agreement.
If the Customer withdraws from the agreement, Meldrone will reimburse all payments received from the Customer up to that point, including the standard delivery costs, within a maximum of 14 calendar days after Meldrone has been informed of the Customer’s decision to withdraw.
For sales contracts, Meldrone may withhold the refund until it has received all returned goods or until the Customer has provided evidence that the goods have been returned, whichever occurs first.
Any additional costs resulting from the Customer choosing a delivery method other than the least expensive standard delivery method offered by Meldrone will not be reimbursed.
The Customer will not incur any fees as a result of the reimbursement.

The Customer cannot exercise the right of withdrawal in relation to:

Any commercial warranty is without prejudice to those statutory rights.
To make a warranty claim, the Customer must be able to provide proof of purchase.

Certain products may also benefit from a separate manufacturer’s commercial warranty, subject to the manufacturer’s applicable warranty conditions.

In addition, the Customer will owe, without prior notice, fixed compensation equal to 10% of the outstanding amount, subject to a minimum of EUR 75 per invoice.
Without prejudice to the above, Meldrone reserves the right to recover products that have not been paid for in full.
Article 10: Severability - No Waiver
If any provision of these Terms and conditions is declared invalid, unlawful or void, this will not affect the validity, legality or enforceability of the remaining provisions.
Any failure by Meldrone at any time to enforce a right set out in these Terms and Conditions, or to exercise any such right, will not be regarded as a waiver of that provision or right and will not affect its validity.
Article 11: Amendments to the Terms and conditions
These Terms and conditions are supplemented by any other terms expressly referred to herein and by Meldrone’s General Conditions of Sale.
In the event of any conflict, these Terms and Conditions will prevail.
Article 12: Evidence
The Customer accepts that electronic communications and electronic records or backups may be used as evidence.
Meldrone has subscribed to the rules of the UNIZO e-commerce label.
